Copyright and Intellectual Property Policy

Last Updated: September 20, 2026

Effective Date: September 20, 2026

Snipcask, owned and operated by Zephtec Digital Solutions ("we", "us", or "our"), respects the intellectual property rights of software engineers, graphic artists, content creators, and corporate copyright holders. We expect all users, buyers, and independent authors on the platform to do the same.

This Copyright and Intellectual Property Policy outlines the procedures for reporting alleged copyright infringement on Snipcask and describes our compliance with the Indian Copyright Act, 1957, the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021, and the notice-and-takedown principles of the Digital Millennium Copyright Act (17 U.S.C. § 512).

1. Intermediary Status & Safe Harbor

Snipcask operates as an online digital marketplace and technological intermediary facilitating transactions between independent digital creators ("Authors") and end purchasers ("Buyers").

Under Section 79 of the Information Technology Act, 2000, and applicable international safe harbor frameworks, Snipcask functions as an intermediary. We do not independently verify title or authorship for every user-generated asset prior to upload, but we enforce strict screening protocols and take swift action upon receiving verified notices of alleged infringement.

2. Notice of Copyright Infringement (Takedown Request)

If you are a copyright owner, or an authorized agent acting on behalf of an owner, and believe that any software script, WordPress plugin, theme, mobile application codebase, UI kit, graphic asset, or text listed on Snipcask infringes upon your copyright, you may submit a written notice containing the information below:

  • Identification of the Protected Work: A clear description or itemized list of the copyrighted work(s) claimed to have been infringed, including registration numbers, source repository URLs, or official purchase links demonstrating your original ownership.
  • Identification of the Infringing Material: The exact URL(s) on snipcask.com where the allegedly infringing asset, image, or text is located. Generic descriptions (such as "all PHP scripts by this author") will delay review; provide direct product URLs.
  • Contact Information: Your full legal name, physical mailing address, operational telephone number, and official email address.
  • Statement of Good Faith Belief: A clear statement asserting:
    • “I have a good faith belief that the use of the copyrighted material described above is not authorized by the copyright owner, its agent, or the law (e.g., fair use).”
  • Statement of Accuracy and Authority: A statement affirming under penalty of perjury that:
    • “The information contained in this notification is accurate, and I declare under penalty of perjury that I am the copyright owner or am authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.”
  • Physical or Electronic Signature: A physical or digital signature of the copyright owner or authorized representative.

3. How to Submit an Infringement Notice

Submit complete infringement notifications through our official intake channel:

  • Online Support / Legal Intake: https://snipcask.com/contact-us
  • Line Format: Copyright Infringement Notice - [Item Name / Product URL]
  • Operating Entity: Zephtec Digital Solutions (Attn: Copyright Grievance Officer)

Notices lacking essential details or verifiable links will require resubmission before processing can begin.

4. Action Taken Upon Receipt of a Valid Notice

Upon receiving a formally complete and valid infringement notice, Snipcask will:

  • Expeditiously Restrict Access: Immediately disable public access to, or permanently remove, the contested listing and downloadable files from the marketplace.
  • Notify the Accused Author: Transmit a copy of the infringement notification (including the claimant's identity and stated grounds) to the author responsible for the listing.
  • Escrow or Freeze Proceeds: Temporarily hold pending author payout balances directly associated with the disputed product pending resolution.

5. Counter-Notification Procedure for Authors

If you are an author whose item was removed or disabled due to a copyright notice and you believe the removal was the result of mistake, misidentification, or legitimate licensing/fair use authorization, you may file a written Counter-Notification containing:

  • Identification of the Material: The title and specific URL(s) of the item before it was disabled or removed.
  • Author Contact Details: Your full legal name, permanent address, telephone number, and email address registered with your Snipcask account.
  • Statement Under Penalty of Perjury: A statement affirming:
    • “I declare, under penalty of perjury, that I have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.”
  • Consent to Jurisdiction: A statement consenting to the jurisdiction of the competent courts in India (or, if outside India, the judicial district where you reside), and confirming that you will accept service of process from the original claimant or their legal agent.
  • Signature: Your physical or valid electronic signature.

Submit counter-notices via our Contact Page using the subject line: Copyright Counter-Notification - [Item Name].

6. Resolution After Counter-Notification

Upon receipt of a valid counter-notification:

  • Snipcask will provide a copy of the counter-notice to the original complaining party.
  • The claimant will have 10 to 14 business days to provide proof that they have initiated formal legal action seeking a court order to restrain the author from engaging in infringing activity relating to the material on the platform.
  • If no verified evidence of legal action is received within this statutory window, Snipcask may, at its sole discretion, restore the disabled item to the catalog and release frozen balances.

7. Repeat Infringer Policy

Snipcask maintains a strict zero-tolerance standard against persistent intellectual property theft:

  • Three-Strike Rule: Any author account that accumulates three (3) substantiated, un-rebutted copyright infringement takedown notices will have their author privileges permanently revoked.
  • Immediate Termination for Severe Violations: We reserve the right to immediately terminate accounts, forfeit unpaid platform earnings, and block banking details for any party discovered uploading known leaked commercial software, warez, cracked binaries, or intentionally backdoored commercial scripts on the first verified offense.

8. Legal Penalties for False or Bad-Faith Claims

Submitting a fraudulent, misleading, or bad-faith copyright infringement notice or counter-notification carries serious legal consequences.

Under applicable laws (including Section 512(f) of the U.S. Copyright Act and relevant provisions of the Indian Penal Code / Bharatiya Nyaya Sanhita), any party who knowingly makes material misrepresentations regarding copyright infringement may be held civilly and criminally liable for damages, including court costs and legal fees incurred by the injured author, Zephtec Digital Solutions, or our service providers.
