These Terms of Service ("Terms") constitute a legally binding agreement between you ("User", "Buyer", "Author", or "you") and Zephtec Digital Solutions ("Snipcask", "we", "us", or "our"), governing your access to and use of the Snipcask marketplace, services, features, and digital content.
By creating an account, browsing our catalog, purchasing digital assets, or submitting items as an author, you confirm that you have read, understood, and agreed to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you must discontinue using Snipcask immediately.
1. Eligibility and Account Registration
- Age Requirement: You must be at least 18 years old and possess the legal authority to enter into binding contracts to register an account or transact on Snipcask.
- Account Accuracy: You agree to provide truthful, accurate, and complete information during registration and keep your account profile updated.
- Account Security: You are solely responsible for maintaining the confidentiality of your credentials and for all activities conducted under your account. You must notify us immediately at our Contact Page of any unauthorized access or security compromise.
- Account Non-Transferability: Accounts, licenses, and seller profiles may not be transferred, assigned, or sold to third parties without prior written consent from Snipcask.
2. Nature of the Marketplace
- Intermediary Platform: Snipcask operates as an online marketplace platform connecting independent creators, developers, and designers ("Authors") with prospective purchasers ("Buyers").
- Role of Snipcask: Except where an asset is explicitly designated as authored directly by Snipcask or Zephtec Digital Solutions, digital assets are authored, uploaded, and maintained by third-party Authors. Snipcask provides transactional processing, hosting, download infrastructure, and basic submission quality checks.

4. Pricing, Payments, and Billing
- Currency and Charges: All item prices are displayed in the listed platform currency (e.g., INR or USD). Prices are set by the platform and Authors and are subject to adjustment without prior notice.
- Payment Processing: Payments are handled through licensed third-party payment aggregators (including Razorpay, PayU, and international payment processors). By placing an order, you authorize our payment processors to charge your selected payment method.
- Taxes: Applicable statutory taxes (such as GST or value-added taxes) will be calculated and added during checkout where mandated by prevailing tax legislation.

- Instant Digital Delivery: Upon successful payment authorization, download permissions are granted immediately to your Snipcask customer dashboard.
- File Updates: Buyers typically receive access to future maintenance updates released by the Author for that specific major release, subject to the Author maintaining the item on the platform. Snipcask does not guarantee perpetual availability of past versions.

8. Prohibited Platform Conduct
You agree not to engage in any of the following activities:
- Attempting to probe, scan, or exploit vulnerabilities in the Snipcask platform, database, or network infrastructure.
- Using automated scrapers, bots, or extraction crawlers to collect catalog data, pricing, or proprietary content.
- Circumventing marketplace transactions by conducting off-platform sales with authors discovered on Snipcask.
- Uploading, posting, or transmitting defamatory, unlawful, infringing, or harmful material.
- Impersonating another person, brand, or registered business entity.
9. Intellectual Property Rights
- Platform IP: All website UI designs, branding, logos, trademarks, text, graphics, and underlying source code of Snipcask belong exclusively to Zephtec Digital Solutions. You may not reproduce, copy, or redistribute platform assets without prior written consent.
- DMCA and Copyright Claims: Snipcask respects the intellectual property rights of others. If you believe your copyrighted work has been infringed by an asset listed on the marketplace, submit a formal takedown request containing proof of ownership to our designated contact channel: https://snipcask.com/contact-us.
10. Disclaimer of Warranties
The Snipcask marketplace, services, and all downloadable items are provided on an "as is" and "as available" basis, without warranties of any kind, either express or implied.
Neither Snipcask nor Zephtec Digital Solutions warrants that:
- The platform or downloadable files will be completely error-free, uninterrupted, or compatible with every server configuration or third-party extension.
- Items downloaded will meet your specific business requirements or achieve particular commercial results.
11. Limitation of Liability
To the maximum extent permitted by applicable law, in no event shall Zephtec Digital Solutions, its proprietor, officers, contractors, or agents be liable for any indirect, punitive, incidental, special, consequential, or exemplary damages—including but not limited to loss of profits, data loss, downtime, or business interruption—arising out of or related to your use of the marketplace or any digital assets obtained through it.
In all circumstances, the total cumulative liability of Zephtec Digital Solutions for any claim arising out of these Terms or the use of Snipcask is strictly limited to the amount paid by you for the specific item or transaction giving rise to the claim.
12. Indemnification
You agree to defend, indemnify, and hold harmless Zephtec Digital Solutions, its proprietor, affiliates, and contractors from and against any claims, damages, liabilities, losses, costs, or expenses (including reasonable legal fees) arising from:
- Your breach of these Terms or your violation of applicable laws.
- Any digital item, source code, or content uploaded by you as an Author.
- Your misuse of any digital product purchased or downloaded from Snipcask.
13. Suspension and Termination
We reserve the right, without liability or prior notice, to suspend or terminate your account, invalidate purchased licenses, or refuse service if we determine that you have violated these Terms, engaged in fraudulent activities, or infringed upon the intellectual property rights of others.
14. Governing Law and Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of India, without regard to conflict of law principles. Any legal suit, action, or proceeding arising out of or related to these Terms or the Snipcask platform shall be instituted exclusively in the competent courts located in India.
15. Modifications to Terms
We reserve the right to amend these Terms at any time. When modifications are made, the "Last Updated" date at the top of this page will be revised. Your continued use of the platform after the posting of revised Terms constitutes your acceptance of the updated conditions.
